Lizenz¶

FitRadarHR wird unter der Functional Source License, Version 1.1, MIT Future License (FSL-1.1-MIT) vertrieben, einer Fair-Source-Lizenz — der Quellcode ist einsehbar, aber nicht „Open Source“ im strengen OSI-Sinn (siehe unten, warum).

FitRadarHR wurde ursprünglich unter der MIT-Lizenz vertrieben. Der Wechsel zu FSL-1.1-MIT erfolgte, um ein mögliches künftiges kommerzielles Angebot (kostenloser Plan, dann Abonnement) vor einer Übernahme des Codes durch Dritte zu schützen, während der Code für internen, pädagogischen oder Forschungsgebrauch weiterhin öffentlich und veränderbar bleibt.

Was das konkret bedeutet¶

✅ Sie können den Code frei einsehen, klonen und studieren ✅ Sie können ihn für Ihren eigenen internen Gebrauch nutzen und anpassen (Ihr Unternehmen, Ihre Organisation) ✅ Sie können ihn zu nicht-kommerziellen Forschungs- oder Bildungszwecken nutzen ✅ Sie können ihn im Rahmen einer Dienstleistung für einen Kunden nutzen, der ihn selbst unter denselben Bedingungen verwendet ✅ Zwei Jahre nach der Veröffentlichung wechselt jede Version automatisch zur MIT-Lizenz — ohne dass Sie etwas unternehmen müssen

❌ Sie dürfen ihn ohne Genehmigung nicht nutzen, um Dritten ein kommerzielles Produkt oder eine Dienstleistung anzubieten, die mit FitRadarHR konkurriert — also FitRadarHR ersetzt, mit einem von uns bereits angebotenen Angebot konkurriert oder eine im Wesentlichen ähnliche Funktionalität bietet

Die einzige Einschränkung bei erlaubten Nutzungen: den Urheberrechtsvermerk und einen Link zur Lizenz in weitergegebenen Kopien beizubehalten.

Kurz gesagt: FitRadarHR für Ihr HR-Team oder Ihre Teams selbst zu hosten bleibt vollständig frei und kostenlos. Vorbehalten ist lediglich, daraus ohne unsere Zustimmung ein konkurrierendes kommerzielles Produkt oder eine Dienstleistung zu machen.

Warum es nicht mehr „Open Source“ im strengen Sinn ist¶

Die offizielle Open-Source-Definition (Open Source Initiative) verbietet jede Einschränkung der kommerziellen Nutzung. Eine Lizenz, die eine Nutzung vorbehält — selbst nur die konkurrierende kommerzielle Nutzung —, ist daher im OSI-Sinn nicht mehr „Open Source“, auch wenn der Code öffentlich und lesbar bleibt. Deshalb sprechen wir von „Fair Source“ statt „Open Source“: Der Code ist offen, aber die Nutzung ist nicht vollständig uneingeschränkt. Andere bekannte Projekte verwenden dasselbe Modell: Sentry, HashiCorp (vor seiner Übernahme), CockroachDB.

### Licensor ("We")
The party offering the Software under these Terms and Conditions.

### The Software
The "Software" is each version of the software that we make available under
these Terms and Conditions, as indicated by our inclusion of these Terms and

A Permitted Purpose is any purpose other than a Competing Use. A Competing Use
means making the Software available to others in a commercial product or

product or service we offer using the Software that exists as of the date we
make the Software available; or (3) offers the same or substantially similar
functionality as the Software.

Permitted Purposes specifically include using the Software: (1) for your
internal use and access; (2) for non-commercial education; (3) for
non-commercial research; and (4) in connection with professional services
that you provide to a licensee using the Software in accordance with these
Terms and Conditions.

### Patents
To the extent your use for a Permitted Purpose would necessarily infringe our
patents, the license grant above includes a license under our patents. If you
make a claim against any party that the Software infringes or contributes to
the infringement of any patent, then your patent license to the Software ends
immediately.

### Redistribution
The Terms and Conditions apply to all copies, modifications and derivatives
of the Software. If you redistribute any copies, modifications or derivatives
of the Software, you must include a copy of or a link to these Terms and
Conditions and not remove any copyright notices provided in or with the
Software.

### Disclaimer
THE SOFTWARE IS PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR

### Trademarks
Except for displaying the License Details and identifying us as the origin of

## Grant of Future License
We hereby irrevocably grant you an additional license to use the Software
under the MIT license that is effective on the second anniversary of the date
we make the Software available. On or after that date, you may use the
Software under the standard MIT license terms.
