Licencia¶

FitRadarHR se distribuye bajo la Functional Source License, versión 1.1, MIT Future License (FSL-1.1-MIT), una licencia Fair Source — código disponible, pero no «open source» en el sentido estricto de la OSI (véase más abajo por qué).

Cambio de licencia — 2026-07-03

FitRadarHR se distribuía originalmente bajo licencia MIT. Pasó a FSL-1.1-MIT para proteger una posible futura oferta comercial (plan gratuito y después suscripción) frente a la reutilización del código por un tercero, manteniendo el código público y modificable para uso interno, educativo o de investigación.

Lo que esto significa en la práctica¶

✅ Puede consultar, clonar y estudiar el código libremente ✅ Puede utilizarlo y modificarlo para su propio uso interno (su empresa, su organización) ✅ Puede utilizarlo con fines de investigación o educación no comerciales ✅ Puede utilizarlo en el marco de una prestación de servicios para un cliente que lo use él mismo bajo estas mismas condiciones ✅ Dos años después de su publicación, cada versión pasa automáticamente a licencia MIT — sin ninguna gestión por su parte

❌ No puede, sin autorización, utilizarlo para ofrecer a terceros un producto o servicio comercial que compita con FitRadarHR — es decir, que lo sustituya, que compita con una oferta que ya proporcionamos, o que ofrezca una funcionalidad sustancialmente similar

La única restricción sobre los usos permitidos: conservar la mención de copyright y un enlace a la licencia en las copias redistribuidas.

En resumen: autoalojar FitRadarHR para su RR. HH. o sus equipos sigue siendo totalmente libre y gratuito. Lo que está reservado es convertirlo en un producto o servicio comercial competidor sin nuestro acuerdo.

Por qué ya no es «open source» en sentido estricto¶

La definición oficial de open source (Open Source Initiative) prohíbe cualquier restricción sobre el uso comercial. Una licencia que reserva un uso — aunque solo sea el uso comercial competidor — ya no es «open source» en el sentido de la OSI, aunque el código siga siendo público y legible. Por eso hablamos de «Fair Source» en lugar de «open source»: el código está abierto, pero el uso no es totalmente sin límites. Otros proyectos conocidos utilizan este mismo modelo: Sentry, HashiCorp (antes de su adquisición), CockroachDB.

### Patents
To the extent your use for a Permitted Purpose would necessarily infringe our
patents, the license grant above includes a license under our patents. If you
make a claim against any party that the Software infringes or contributes to
the infringement of any patent, then your patent license to the Software ends
immediately.

### Redistribution
The Terms and Conditions apply to all copies, modifications and derivatives
of the Software. If you redistribute any copies, modifications or derivatives
of the Software, you must include a copy of or a link to these Terms and
Conditions and not remove any copyright notices provided in or with the

### Disclaimer

we make the Software available. On or after that date, you may use the
